By accessing and using MokkaGen (“the Service”) at mokkagen.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MokkaGen provides AI-powered product photography services. You upload product images, select a style, and our AI generates styled product photos. The Service is available through our web application and REST API.

3. Account Registration

• You must provide a valid email address and create a password.
• You are responsible for maintaining the security of your account.
• You must not share your account or API keys with third parties.
• You must be at least 18 years old to use the Service.

4. Credits and Payments

• The Service operates on a credit-based system. Credits are purchased in packs.
• Credits are non-transferable and have no cash value.
• Prices are displayed in EUR and include applicable taxes.
• Payments are processed securely by Stripe.
• Credits for failed generations are automatically refunded to your balance.

5. Satisfaction

6. Acceptable Use

You agree not to:

• Upload illegal, harmful, or offensive content.
• Use the Service to generate misleading or fraudulent product imagery.
• Attempt to reverse-engineer, exploit, or abuse the Service.
• Exceed reasonable usage limits or abuse the API.
• Resell or redistribute the Service without authorization.

7. Intellectual Property

• You retain ownership of images you upload.
• You receive a full license to use generated images for any commercial purpose.
• MokkaGen does not claim ownership of your generated images.
• The MokkaGen brand, website, and technology are our intellectual property.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications at any time. We are not liable for any downtime or data loss.

9. Limitation of Liability

The Service is provided “as is” without warranties of any kind. MokkaGen shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account for violation of these terms. You may close your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of significant changes via email.

12. Governing Law

These terms are governed by the laws of France. Any disputes shall be resolved in the courts of France.
